These Terms of Service ("Terms") govern your use of the QA Mode browser extension and related services ("Service") provided by Daniel Feinberg, doing business as QA Mode ("we," "us," "our"). By using QA Mode, you agree to these Terms.
1. Service Description
QA Mode is a browser extension for reporting bugs and feedback. It lets you:
- Capture screenshots of web pages you are testing
- Record voice or text descriptions of bugs
- Automatically structure reports using AI
- Create issues on your connected issue tracker
- Capture technical context (console errors, network requests, environment info) for debugging
- View, edit, and share hosted reports via unique links on qamode.io
2. Eligibility
You must be at least 16 years old to use QA Mode. By using the Service, you represent that you meet this requirement. If you are using QA Mode on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Accounts
3.1 Registration
You need a QA Mode account to use the Service. You are responsible for maintaining the security of your account credentials.
3.2 Account Security
You are responsible for all activity under your account. Notify us immediately at danny@qamode.io if you suspect unauthorized access.
4. Acceptable Use
4.1 Permitted Uses
You may use QA Mode to:
- Report bugs and feedback on websites and applications you use
- Capture technical context to help developers understand issues
4.2 Prohibited Uses
You may NOT use QA Mode to:
- Surveil individuals without their knowledge or consent
- Scrape website content for data collection or competitive intelligence
- Capture sensitive personal data of third parties (health records, financial data, government IDs) without appropriate authorization
- Circumvent security measures, access controls, or rate limits
- Reverse engineer the Service or its AI components
- Resell or redistribute the Service without our written consent
- Violate any applicable law, regulation, or third-party rights
- Interfere with the Service's operation or other users' access
- Upload malicious content, malware, or harmful code
- Use the Service for any purpose other than software feedback and bug reporting
5. Usage Limits
We may impose usage limits on the Service. If you exceed applicable limits, some features may be temporarily restricted.
6. Intellectual Property
6.1 Your Content
You retain all rights to the reports, screenshots, descriptions, and other content you create using QA Mode ("Your Content").
Limited license to us: You grant us a non-exclusive, worldwide, royalty-free license to host, process, and transmit Your Content solely to provide the Service. This license:
- Is limited to what is technically necessary to operate the Service
- Does not include the right to use Your Content for marketing, training AI models, or any purpose beyond service delivery
- Terminates when you delete your account
6.2 AI-Generated Content
Report titles, steps to reproduce, and other structured content generated by AI from your input are considered part of Your Content. You own the output. We claim no rights to AI-generated content.
6.3 Our IP
QA Mode, including its software, design, documentation, and trademarks, is our property. These Terms do not grant you any rights to our IP beyond the right to use the Service.
7. Issue Tracker Integrations
7.1 Your Accounts
When you connect a third-party issue tracker, QA Mode creates issues using your OAuth credentials on your account. We do not have independent access to your issue tracker account.
7.2 Your Responsibility
You are responsible for:
- Ensuring you have permission to create issues in the connected repositories/projects
- The content of reports you submit (even if AI-assisted)
- Compliance with your issue tracker's terms of service
7.3 Token Storage
OAuth tokens are encrypted at rest and stored server-side. Tokens are deleted when you disconnect the integration or delete your account.
7.4 Hosted Reports
Reports you create are stored server-side and accessible via a unique link. Anyone with the link can view the report. You are responsible for sharing report links appropriately. Reports are deleted when you delete your account.
8. AI Processing
8.1 How It Works
QA Mode uses third-party AI to structure your input into a formatted issue. Report content you provide is sent to a third-party AI provider for structuring.
8.2 AI Limitations
AI-generated content may be inaccurate. You are responsible for reviewing and editing the generated report before submission. The review modal is provided for this purpose.
8.3 No Model Training
Your data is not used to train AI models. We select AI providers whose terms prohibit using customer data for model training, and we do not opt into any data sharing programs.
9. Privacy
Your use of QA Mode is subject to our Privacy Policy, which describes how we collect, use, and protect your data.
10. Warranty Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, error-free, or secure
- AI-generated content will be accurate or complete
- Screenshots will capture all relevant information
- The Service will be compatible with all websites or browsers
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QA Mode'S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF:
- The amount you paid for the Service in the 12 months preceding the claim, OR
- $100 USD
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, OR BUSINESS OPPORTUNITIES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Indemnification
You agree to indemnify and hold QA Mode harmless from claims, damages, and expenses (including reasonable legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Content you create or submit through the Service
13. Termination
13.1 By You
You may stop using QA Mode at any time by uninstalling the extension and deleting your account through your account settings.
13.2 By Us
We may suspend or terminate your access if:
- You violate these Terms
- Your use poses a security risk to the Service or other users
- Required by law
- We discontinue the Service (with reasonable notice)
13.3 Effect of Termination
Upon termination:
- Your right to use the Service ends immediately
- Local extension data remains on your device until you uninstall
- Server-side data (screenshots, hosted reports, encrypted OAuth tokens, usage records) is deleted immediately
- Provisions that by their nature should survive (IP, liability, indemnification) will survive termination
14. Changes to Terms
We may update these Terms. For material changes, we will:
- Post the updated Terms at qamode.io/terms
- Notify you via email at least 30 days before the changes take effect
- Note the new effective date
Continued use after the effective date constitutes acceptance. If you disagree with changes, your remedy is to stop using the Service and delete your account.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law principles.
Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Washington. Both parties consent to personal jurisdiction in these courts.
Small claims exception: Either party may bring claims in small claims court if eligible.
16. General
- Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and QA Mode regarding the Service.
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
- No waiver: Our failure to enforce a provision does not waive our right to enforce it later.
- Assignment: You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure: We are not liable for delays or failures caused by events beyond our reasonable control.
