Terms of Service
These Terms of Service ("Terms") govern your use of QA Mode ("Service"), provided by Daniel Feinberg, doing business as QA Mode ("we," "us," "our"). By using QA Mode, you agree to these Terms.
1. What QA Mode Is
QA Mode is a bug reporting tool with a mobile app (iOS and Android) and a web app at qamode.io. It lets you:
- Share a screenshot or screen recording from your phone into QA Mode
- Add a written note describing the issue
- Send it to your team's shared inbox
- Review and edit reports on the web
- Create an issue in GitHub, Jira, Linear, or Trello from a report
- Share a report with anyone via a link
2. Eligibility
You must be at least 16 years old. If you use QA Mode on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Accounts
You need an account to use QA Mode. You are responsible for keeping your account secure and for all activity under it. If you suspect unauthorized access, email danny@qamode.io.
4. Acceptable Use
QA Mode is for reporting bugs and feedback on software you are testing or using.
You may NOT use QA Mode to:
- Surveil individuals without their knowledge or consent
- Capture sensitive personal data of third parties (health records, financial data, government IDs) without proper authorization
- Scrape or harvest content for data collection or competitive intelligence
- Circumvent security measures, access controls, or rate limits
- Reverse engineer the Service
- Resell or redistribute the Service without our written consent
- Violate any law, regulation, or third-party right
- Interfere with the Service or other users' access to it
- Upload malware or harmful content
- Use the Service for anything other than software feedback and bug reporting
5. Usage Limits
Your plan may include a monthly allowance of reports. If you exceed it, some features — including sending reports to an issue tracker — may be restricted until the next period or until the plan is upgraded.
6. Teams and Shared Content
Reports you send to a team are visible to every member of that team. That is what a shared inbox is. Teammates can view, edit, send, and delete (recoverable for a short window in the app) team reports.
Reports you send to a team stay with the team. If you leave the team or delete your account, those reports remain in the team's inbox. Delete a report before you go if you do not want it to stay.
7. Share Links
When a report is sent to an issue tracker, we create a link to a read-only view of it so people reading the issue can see the screenshot and note. Anyone with that link can view the report without signing in. You are responsible for who you give it to. A share link stays valid until the report is deleted. We do not currently offer a way to revoke a link on its own — delete the report if you need the link to stop working.
Images and recordings are served from long, unguessable web addresses so your issue tracker can display them. Anyone holding an address can view that file.
8. Your Content
You keep all rights to the screenshots, recordings, notes, and reports you create with QA Mode ("Your Content").
Limited license to us: you grant us a non-exclusive, worldwide, royalty-free license to store, process, and transmit Your Content solely to operate the Service. This license is limited to what is technically necessary, does not permit use for marketing or AI model training, and ends when the content is deleted.
Our IP: QA Mode's software, design, documentation, and trademarks are ours. These Terms grant you the right to use the Service, nothing more.
9. Issue Tracker Integrations
When you connect GitHub, Jira, Linear, or Trello, QA Mode creates issues using your credentials on your account. We have no independent access to your tracker.
You are responsible for having permission to create issues in the projects you connect, for the content of what you send, and for complying with your tracker's terms.
Your access tokens are encrypted and stored server-side. They are deleted when you disconnect the integration or delete your account.
10. Privacy
Your use of QA Mode is subject to our Privacy Policy.
11. Warranty Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure; that every report will upload or reach your issue tracker; or that the Service will be compatible with every device or tracker configuration.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY.
13. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, your violation of third-party rights, or content you submit.
14. Termination
By you: delete your account in the mobile app (Settings → Account → Delete account) or on your account page at qamode.io, and uninstall the app.
By us: we may suspend or terminate your access if you violate these Terms, if your use poses a security risk, if required by law, or if we discontinue the Service (with reasonable notice).
On termination: your right to use the Service ends immediately. Your personal reports and their images, your tracker tokens, and your account data are deleted immediately. Reports you sent to a team remain with that team (Section 6). Provisions that should survive by their nature — IP, liability, indemnification — survive.
15. Changes to These Terms
We will post updated Terms at qamode.io/terms with a new effective date and email you at least 30 days before material changes take effect. Continued use after that date means you accept them. If you disagree, stop using the Service and delete your account.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Washington, and both parties consent to personal jurisdiction there.
Small claims exception: either party may bring an eligible claim in small claims court.
17. App Store Terms
If you obtained the mobile app from the Apple App Store or Google Play, that store's terms also apply to your download and use of the app. These Terms are between you and QA Mode only — Apple and Google are not parties to them and are not responsible for the Service or for support.
18. General
- Entire agreement: these Terms and the Privacy Policy are the whole agreement between you and QA Mode regarding the Service.
- Severability: if a provision is unenforceable, the rest stays in effect.
- No waiver: not enforcing a provision does not waive our right to enforce it later.
- Assignment: you may not assign these Terms. We may assign them in a merger, acquisition, or sale of assets.
- Force majeure: we are not liable for delays caused by events beyond our reasonable control.
